TL;DR

  • Automatic extension: your California license stays valid your entire active duty outside California, plus 30 days after honorable discharge or return — under CVC §12817. Doesn’t apply if your license was suspended.
  • Get the DL 236 card: call (916) 657-7790 to update your DMV record (prevents it from being purged). Carry the card with your license, especially in other states.
  • Within 30 days of return: complete a DL 44, visit a DMV office in person, pay the fee, give a fingerprint, pass a vision exam, get your photo taken, and pass a knowledge test.
  • Registration waiver: late penalties waived for qualifying deployments under CVC §9560 — file REG 256 within 60 days of deployment end. Training-only duty and PCS moves don’t qualify.

How the Automatic Extension Works

Under California Vehicle Code §12817, a California driver’s license held by a member of the U.S. Armed Forces “shall continue in full force and effect” for as long as the service continues and the person remains absent from California — plus up to 30 days after honorable separation or return to the state, whichever comes first.

The extension is automatic by statute. But the DMV adds an important warning: “It is important to update your driving record to prevent it from being purged.” Call (916) 657-7790 to register the extension and request your DL 236 card (see below).

The DL 236 Card — How to Get It

The DL 236 “Extension of License for Person in Armed Forces” is a physical card issued by the DMV that cites CVC §12817 as the legal authority for your extension. Carry it alongside your (technically expired) California license whenever you drive — especially in another state, where an officer checking your license will see a past expiration date.

How to get it: call the DMV at (916) 657-7790 to update your driving record. The DMV mails the DL 236 card to you. There is no fee for the card itself.

If you are not returning to California, present your California license plus the DL 236 card at your new state’s DMV when you apply for a license there.

One caveat: other states are not required to honor California’s extension. The DMV advises: “If on duty in another state or country, check with authorities whether they will honor your extended DL.” Carry your DL 236 card and a copy of your military orders.

Spouses and Dependents

Your spouse gets the same extension under CVC §12817(b) — as long as the service member continues in service, remains absent from California, and the spouse also remains absent from California.

The spouse’s 30-day clock starts at the earliest of: the service member’s honorable separation, the service member’s return to California, or the spouse’s own return to California. During the 30-day window, the spouse must carry the service member’s discharge/separation papers.

Edge case: if your spouse moves back to California while you are still deployed, the spouse’s extension ends 30 days after the spouse’s return — they must renew normally at that point.

Dependents with an expiring California license have two options: call (916) 657-7790 to renew, or request a no-fee one-year extension by mail — write to Department of Motor Vehicles, PO Box 942890, Sacramento, California 94290-0001, and include your full name as shown on the license, license number, birth date, and address.

When You Return to California — The 30-Day Checklist

Within 30 days of discharge or return to California, complete these steps:

  1. Complete the application first. Fill out form DL 44 (or the online eDL 44) before visiting — DL 44C if you hold a commercial license.
  2. Visit a DMV office in person. Military renewals on return cannot be done online.
  3. Pay the application fee. The fee is nonrefundable and covers 12 months (verify the current amount at dmv.ca.gov).
  4. Give a fingerprint scan and have a new photo taken.
  5. Pass a vision exam (20/40 with both eyes).
  6. Pass a knowledge test. The application fee covers three attempts within 12 months.

Need a replacement license while still away? Service members, spouses, and dependents can call (916) 657-7790 for a duplicate license without a photo — it is issued stating “Valid without photo.”

Registration Penalty Waiver (CVC §9560)

Separate from your license: under CVC §9560, the DMV shall waive all late-payment penalties on vehicle registration renewal for any period you were deployed outside California.

Who qualifies: you must have been ordered to temporary military duty during a period when a Presidential Executive Order specified the U.S. was engaged in combat or homeland defense, as a member of the armed forces, reserves, or National Guard called to active duty.

What does NOT qualify: temporary duty solely for training or processing, and permanent change of station (PCS) moves. And the waiver does not apply if you apply for renewal more than 60 days after your deployment ends.

How to claim it: complete form REG 256 (Statement of Facts) stating your military membership and deployment termination date, and bring it with your renewal to a DMV office. For the full renewal walkthrough, see our California registration renewal guide.

Stationed in California With Out-of-State Plates

Nonresident military members stationed in California may keep driving on a valid home-state license and keep home-state registration under CVC §6701 — as long as the plates and registration are in the member’s or spouse’s name (from the last duty station or claimed home state), the vehicle is insured, and it is not used commercially.

After discharge: if you stay in California, registration is due within 20 days of accepting gainful employment or becoming a California resident (CVC §516) — penalties apply after that.

What the Extension Does NOT Cover

  • Suspended licenses — §12817 explicitly does not protect licenses suspended, canceled, or revoked for cause.
  • Other states’ recognition — no state is required to honor the extension; always check locally.
  • Fee discounts — there is no military discount on renewal fees in the statute; you pay the standard fee on return.
  • Registration deadlines — the license extension and the §9560 registration waiver are separate rules with separate requirements.

Frequently Asked Questions

Does California automatically extend my driver’s license while I’m deployed?

Yes. Under CVC §12817, your California license stays valid your entire active duty outside California, plus 30 days after honorable discharge or return — whichever comes first. Update your DMV record by calling (916) 657-7790 so it isn’t purged, and carry the DL 236 card with your license.

Does the military extension cover my spouse’s license?

Yes — as long as your spouse also remains outside California. The spouse’s 30 days start at the earliest of your separation, your return, or their return. If your spouse moves back while you’re still deployed, their extension ends 30 days after their return.

What is the DL 236 card and how do I get one?

The “Extension of License for Person in Armed Forces” card cites CVC §12817 as authority for your extension. Call the DMV at (916) 657-7790 to update your driving record and the DMV mails it to you. Carry it with your license at all times.

Will other states accept my extended California license?

Not necessarily. Other states are not required to honor the extension. The DMV advises checking with authorities where you’re stationed. Carry your DL 236 card and a copy of your military orders.

What do I have to do when I return to California?

Within 30 days: complete a DL 44 (or eDL 44 online first; DL 44C for commercial), visit a DMV office in person, pay the fee, give a fingerprint, pass a vision exam, have your photo taken, and pass a knowledge test.

My license already expired while I was out of state. Can I still get the extension?

Yes. Call (916) 657-7790 to apply for renewal, or request a no-fee one-year extension by writing to: Department of Motor Vehicles, PO Box 942890, Sacramento, California 94290-0001. Include your full name as on the license, DL number, birth date, and address.

Civilian, not military? The automatic extension above is for service members. Civilians temporarily out of state use a different route — see our guide to renewing a California license while out of state.

Can my dependent get an extension while I’m deployed?

Yes. Dependents with an expiring California license can call (916) 657-7790 to renew or request the no-fee one-year extension by mail to the same PO Box above.

Do I get a waiver on late registration penalties after deployment?

Under CVC §9560, the DMV waives late penalties for the deployment period — but only for temporary duty during a Presidential Executive Order combat/homeland-defense period, and only if you apply within 60 days of deployment end. Training-only duty and PCS moves don’t qualify. Bring a completed REG 256 to the DMV.

I’m stationed in California but my home state is elsewhere. Do I need a California license?

No. Nonresident military may drive on a valid home-state license and keep home-state registration under CVC §6701 conditions. After discharge, register in California within 20 days of employment or residency.

Does the extension apply if my license was suspended?

No. CVC §12817 does not protect licenses that were suspended, canceled, or revoked.

What if I’m not returning to California?

Go to your new state’s DMV, follow its requirements, and present your California license with the DL 236 card.

Is there a renewal fee when I return?

You’ll pay the standard nonrefundable application/renewal fee at the DMV office. Verify the current amount at dmv.ca.gov before your visit.
