Gender Marker Change on California Driver's License: M, F, X (2026)

Since January 1, 2019, California lets you self-select your gender marker — M, F, or X — on your driver’s license or ID card. No court order, no medical certification, no extra fees beyond the standard application fee.

We’re an independent guide — not the DMV. This page explains the California DMV’s official process for changing the gender category on your driver’s license or ID card. The information below is based on the DMV’s published guidance; the DMV makes the final determination on every application.

TL;DR

1What California law allows

Effective January 1, 2019, California’s SB 179 (the Gender Recognition Act) gave applicants the right to self-select their gender category — male (M), female (F), or nonbinary (X) — on a California driver’s license or identification card. The DMV’s official guidance states that no court order and no medical certification are required for the gender-marker change itself.

This applies to original licenses and IDs, renewals, and corrections to existing licenses and IDs. The process is separate from a legal name change, though both can be handled in the same office visit.

2Documents you need

For a gender-marker-only change on a standard (non-REAL ID) license or ID, the DMV’s current guidance does not require additional documents beyond the new DL/ID application and your current license or ID card.

If you are also applying for REAL ID in the same application, you will need the standard REAL ID document set: proof of identity, your Social Security number, and two proofs of California residency. The DMV’s guidance does not list any additional gender-specific documents beyond the standard REAL ID requirements.

Important distinction: no SSA update is required for a gender-only change — that requirement applies only to legal name changes, not gender-marker changes.

3Step-by-step: changing your gender marker

  1. Complete a new driver’s license or ID card application. Start the application online on the DMV’s website, or complete it at the office.
  2. Gather your documents. For a gender-only change, your current license or ID card and the application are what the DMV’s guidance calls for. Bringing additional identity documents is never a bad idea if you have them.
  3. Visit a DMV field office. This step is required — the DMV’s own wording is: “Your gender category change isn’t complete until you come into a field office!” You cannot complete the change online.
  4. At the office, staff will process your application, scan your thumbprint, and take a new photo. You will receive a temporary driver’s license on the spot.
  5. Your new card arrives by mail in approximately 3–4 weeks. If you have not received it after 60 days, use the DMV’s online driver license and ID card status tool.

4What it costs

The DMV’s page refers to paying the “appropriate licensing fee” for a gender category change. The DMV’s official licensing fee schedule lists a change-of-information fee of $37 for a Class C license (as of October 2026). Note that the DMV’s gender-change page does not name a specific dollar figure itself, so treat the $37 as the current schedule’s change-of-information fee, dated October 2026.

There is no extra fee specific to the gender-marker change beyond the standard application fee. If you upgrade to REAL ID in the same application, REAL ID costs no extra either — the fee is the same as the underlying license or ID.

5Changing your name at the same time

Yes — you can change your name and gender marker in the same DMV visit. But the name portion has stricter requirements:

6REAL ID and the gender marker

You can apply for REAL ID in the same application as your gender-marker change. The standard REAL ID document requirements apply (proof of identity, Social Security number, two California residency proofs), and no additional gender-specific documentation is listed by the DMV beyond the standard set.

REAL ID costs no extra fee on top of the regular license or ID application fee.

7What to expect at the office

Book an appointment through the DMV’s official scheduler to reduce your wait. At the office, bring your completed application, your current license or ID, and — if you are also changing your name — your certified legal-name document. Staff will process the application, capture your thumbprint and photo, and issue a temporary license valid for 60 days while the new card is mailed.

Topic focus: Gender-marker-specific only. Forms, court process, federal vs state rules, timeline, sequencing.

The Two Paths (California)

Path A — Self-attestation (fast): Under the Gender Recognition Act (SB 179), since January 1, 2019 you self-select Female (F), Male (M), or Nonbinary (X) on a new DMV application. Declare under penalty of perjury that the change reflects your gender identity and is not fraudulent. No court order, no doctor’s letter, no therapist’s note, no court appearance. Same self-attestation works for CA birth certificates and marriage certificates. Path B — Court order (slower, broader): needed if you also want a legal NAME change, or need a decree for out-of-state/federal/employer purposes. You can petition for name + gender change in ONE proceeding.

Do I need a court order to change my gender marker?

No. Since January 1, 2019 (SB 179), California allows you to self-select M, F, or X on your driver’s license or ID card with no court order and no medical certification required, per the DMV’s own guidance.

Is the X (nonbinary) marker available in California?

Yes. California’s driver’s license and ID card applications include M (male), F (female), and X (nonbinary) options.

Do I have to visit a DMV office in person?

Yes. The DMV states that the gender category change isn’t complete until you come into a field office. Book an appointment through the official DMV scheduler.

Can I change my name and gender marker in the same visit?

Yes. However, the name portion requires you to update your name with the Social Security Administration first, and you must bring a certified legal-name document. The gender-marker change alone has no SSA requirement.

How much does it cost?

The DMV’s page refers to the “appropriate licensing fee.” The official fee schedule lists a change-of-information fee of $37 for a Class C license (October 2026). There is no separate fee specific to the gender-marker change.

Can I apply for REAL ID at the same time?

Yes. You can apply for REAL ID in the same application. The standard REAL ID document set applies, and REAL ID costs no extra fee beyond the regular license or ID fee.

Ready to make the change?

Book your DMV appointment through the official scheduler, complete your application in advance, and bring the documents listed above to your office visit.
